These Terms and Conditions (“Terms”) constitute a legally binding agreement between EasyNiftyTrade.in (Sachin Srivastava) (“Company”, “we”, “our”, “us”) and the user (“you”, “your”, “subscriber”) who accesses, registers, or purchases any service/product through our website www.easyniftytrade.in (“Website”) and payment gateway partner Cashfree.

By accessing, browsing, registering, or making payments on our Website, you agree to be bound by these Terms, our Privacy Policy, and all applicable Indian laws. If you do not agree, please refrain from using our services.

1. Eligibility

• You must be 18 years or older and legally competent under the Indian Contract Act, 1872.
• By using our Website, you confirm that all information you provide (including TradingView ID, email, contact details) is true, accurate, and complete.

2. Services

• We provide access to invite-only TradingView indicators, tools, and related subscription-based services.
• Access is personal, non-transferable, and non-exclusive.
• Misuse, resale, or unauthorized sharing of access may lead to termination without refund.

3. Payments & Refunds

• All payments are processed securely through Cashfree Payments India Pvt. Ltd.
• All sales are final, non-refundable, and non-transferable once the service is activated.
• Refunds shall only be entertained in case of duplicate transactions, subject to our sole discretion.
• You are solely responsible for entering correct TradingView ID and details. We are not liable for activation delays or failures due to incorrect/incomplete details.

4. Intellectual Property

• All content, scripts, code, graphics, and materials are the exclusive property of www.easyniftytrade.in.
• You are prohibited from copying, reselling, or distributing our services. Any violation shall attract legal action under the Copyright Act, 1957 and other applicable laws.

5. User Conduct

You agree not to:

• Misuse the Website or services for unlawful purposes.
• Upload harmful, abusive, defamatory, or infringing material.
• Circumvent or attempt to hack, copy, or reverse engineer our platform or indicators.

6. Limitation of Liability

• Our services are provided on an “AS IS” basis, without warranties.
• We are not liable for trading losses, business losses, indirect or consequential damages arising from the use of our indicators/tools.
• Your reliance on our services is entirely at your risk.

7. Indemnity

You agree to indemnify and hold harmless EasyNiftyTrade, its owner, affiliates, employees, and partners from any claims, damages, or expenses arising from:

• Your breach of these Terms,
• Misuse of our services,
• Violation of applicable laws.

8. Compliance with Laws

• These Terms are published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
• You must comply with all applicable Indian laws, including IT Act, Copyright Act, Consumer Protection Act, and RBI/SEBI guidelines.

9. Termination

We may suspend or terminate your access without prior notice if:

• You breach these Terms,
• Provide false details,
• Misuse our services.
  No refund will be provided in such cases.

10. Governing Law & Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of India.
• Courts at New Delhi, India shall have exclusive jurisdiction over any disputes.

11. Force Majeure

We shall not be liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, cyberattacks, government restrictions, or internet outages.

12. Amendments

We reserve the right to update, modify, or revise these Terms at any time. The latest version will always be available on our Website. Continued use after changes implies acceptance.
